Summary: FamilySponsored provides AI and information services for incarcerated individuals, sponsored by their family and friends and delivered by eMessage. By using our service, you agree to these terms.

1. Acceptance of Terms

By accessing and using FamilySponsored services, creating an account, or purchasing a subscription, you accept and agree to be bound by these Terms of Service. If you do not agree, please do not use our service.

2. Description of Service

FamilySponsored provides AI and information services for family sponsors including:

AI-generated responses to research and information requests
Recurring updates via our TASK system
Image generation and processing (up to 5 images per eMessage)
Creative writing assistance (letters, poems, stories)
Educational content and career preparation resources
Ongoing projects, and sharing of selected responses with the family sponsor

3. Account Types and Registration

Customer Accounts (Family/Friends)

To purchase and manage subscriptions, you must:

Be 18 years or older
Provide accurate and complete information
Maintain the security of your account credentials
Accept responsibility for all activities under your account

4. Acceptable Use Policy

Users agree not to use FamilySponsored to:

Prohibited Content

Request illegal information or activities
Circumvent facility security policies
Harass, threaten, or harm others
Generate inappropriate content
Violate correctional facility rules

System Integrity

Attempt unauthorized access
Interfere with service operation
Share account credentials
Manipulate subscription systems
Abuse AI request limits

Your Responsibility for Content

All content sent to or from the messaging account used for your subscription is your responsibility, whether that account is in your name or operated on your behalf. This includes:

Every request sent by the incarcerated individual you sponsor
Every response, image, and attachment delivered in reply to those requests
Any consequence of that content under the correctional facility's rules, including rejected messages, used stamps, and restrictions placed on the account or on the incarcerated individual

FamilySponsored does not review or approve individual requests or responses before they are delivered, and is not responsible for their content. You agree that FamilySponsored is not liable for any claim, loss, or penalty arising from content sent to or from your account.

Rejected or Censored Messages

The correctional facility reviews messages under its own rules. It may reject, censor, return, alter, delay, or remove any request, response, image, or attachment, with or without giving a reason. FamilySponsored does not control those decisions and cannot reverse them.

Every response delivered under your subscription is your responsibility as the family sponsor, including any response that is rejected or censored. You, not FamilySponsored, are responsible for the outcome, including the stamps used by the message, any notice or restriction issued by the correctional facility, and any effect on the incarcerated individual. A rejected or censored message does not entitle you to a refund or credit of plan fees or stamps.

Compliance: All content must comply with the correctional facility's policies. The correctional facility may reject FamilySponsored eMessage requests or responses that violate these policies. FamilySponsored is not held responsible for denied eMessages due to content violations.

5. Subscription and Billing

Pricing

$10 for 30-day access or $25/month for access per sponsored resident
Messaging stamps are separate from the plan price. Stamps are sold in packages at the provider's prices, including its fees and any taxes, and are charged to your payment card
Requests and responses use stamps at the provider's rates. Responses with images, and long responses split across several messages, may use more stamps
With Auto-Reload on, a new stamp package is purchased automatically when your stamp balance runs low

Billing Terms

The plan fee is charged when you sign up
The $25/month plan renews automatically each month until you cancel. The $10 30-day access is a one-time purchase and does not renew
Cancel anytime - service continues through paid period
No refunds for partial months
Used stamps are not refunded, including stamps used by a message that the correctional facility rejects or censors
You are responsible for all applicable taxes

6. Service Delivery and Limitations

Response Times

Request processing typically takes a few minutes. eMessage delivery times vary by facility procedures and can take up to several days. Facility mail rooms typically are not operating during weekends or holidays.

Message Limits

Maximum characters per eMessage varies per state. Maximum 20,000 characters in Colorado, 4,000 in Florida and 2,000 in California are examples of the variation. Check with your local state to get current limits.

Long responses automatically split across multiple messages

Service Availability

While we strive for 99.9% uptime, we cannot guarantee uninterrupted service due to:

eMessage provider system maintenance or outages
Facility lockdowns or restrictions
AI service provider limitations
Scheduled maintenance (with advance notice when possible)

7. Privacy and Data Security

Your privacy is important to us. Key points:

8. Intellectual Property

FamilySponsored Property

The FamilySponsored service, software, and branding remain our exclusive property.

User Content

You retain ownership of your requests and personal content
AI-generated responses are provided for your use
We may use anonymized data to improve our services

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:

Accuracy or completeness of AI-generated content
Fitness for any particular purpose
Uninterrupted or error-free service
Compatibility with all correctional facilities

10. Limitation of Liability

FamilySponsored SHALL NOT BE LIABLE FOR:

Any indirect, incidental, or consequential damages
Loss of data or service interruptions
Actions taken based on AI-generated content
eMessage provider system issues or facility restrictions
Content sent to or from your account, or any action a correctional facility takes because of it

Our total liability shall not exceed the amount paid for the service in the preceding month.

11. Termination

By You

You may cancel your subscription at any time through your account dashboard.

By FamilySponsored

We may suspend or terminate service for:

Violation of these terms or acceptable use policy
Non-payment of subscription fees
Requests that consistently violate content policies
Any activity harmful to our service or other users

12. Modifications to Service and Terms

We reserve the right to:

Modify or discontinue features with reasonable notice
Update these terms as needed
Change pricing with 30 days advance notice

Continued use after changes constitutes acceptance of modified terms.

13. Governing Law and Disputes

Any disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association rules.

14. No Affiliation

FamilySponsored is an independent service. It is not affiliated with, endorsed by, or operated by any tablet or eMessage provider, any state government, any department of corrections, or any correctional facility.
